2018 CAO UPDATE
The City of Richland’s Critical Areas Ordinance (CAO) was appealed to the Growth Management Hearings Board (GMHB). The GMHB determined that in designating and protecting Critical Areas under the Growth Management Act, the City’s CAO failed to include the Best Available Science in developing policies and development regulations to protect the functions and values of Critical Areas and Ecosystems. The GMHB determined that RMC 22.10.185 failed to comply with the requirements of RCW 36.70A.060(2) and RCW 36.70A.172(1). In addition, RMC 22.10.200 and RMC 22.10.210 failed to comply with the requirements of RCW 36.70A.060(2) and RCW 36.70A.172(1). As a result, the CAO was remanded back for the City to take corrective action regarding the following:
1. In designating Fish and Wildlife Habitat Conservation Areas, the City of Richland failed to include the Best Available Science when it gave no consideration to the high quality ecosystem and rare plant categories and listing from the DNR Natural Heritage Program, a recognized source of Best Available Science.
2. The City of Richland failed to include the Best Available Science when it gave no consideration to designating species and habitats of local importance as Fish and Wildlife Habitat Conservation Areas.
3. The City of Richland failed to include Best Available Science where, under RMC 22.10.200, a required habitat conservation report is triggered only for development proposals occurring “within” a FWHCA but is not triggered for development proposals occurring in the adjacent buffer or close to the FWHCA so as to impact ecosystem functions and values of the FWHCA.
Please review the attached changes and submit comments back to Mike Stevens, Planning Manager, firstname.lastname@example.org no later than 5:00 PM, Friday, November 30, 2018. Comments received will then be provided to the City’s Planning Commission during a workshop scheduled for Wednesday, December 12, 2018. Input from the Planning Commission workshop will then be used to prepare a final draft that will be distributed for additional comment prior to a duly noticed public hearing (TBD).
M2018-100 Willowbrook Place
The Willowbrook Place Apartment project has been placed on “HOLD” pending the submittal of additional information by the applicant. Once all of the requested information has been received, the City of Richland will re-initiate the public hearing and review process. The City has officially “WITHDRAWN” the Mitigated Determination of Non-Significance which was originally issued for the project on August 3, 2018. A new SEPA Threshold Determination will be made after the new public review/comment period has expired. Notification will be re-sent to all property owners within 300’ of the project site, published in the Tri-City Herald, posted on the City’s website, posted on-site, and provided to all current parties of record once the requested materials have been submitted and the project review has been determined ready to proceed. Until the new public comment period has been determined, the City respectfully requests that no new comments be submitted.
